USTA Announces Official Support for the Federal WAGER Act (HR 4630)

Columbus, OH – The US Trotting Association announced Monday (Dec. 8) that it has formally signed off on the passage of the WAGER Act (HR 4630), federal legislation introduced by Rep. Andy Barr (R-KY) who would restore full, 100% deductibility of gambling losses.

The law aims to undo the provisions of the One Big Beautiful Bill Act of 2025, which aims to reduce the deductibility of betting losses to 90% from January 1, 2026.

Following the recommendation of USTA Executive Vice President and CEO Mike Tanner, the Association’s Executive Committee voted to approve the approval. With the passage, the USTA now publicly joins a growing list of industry organizations advocating for the passage of HR 4630.

“The WAGER Act provides meaningful tax fairness for horseplayers and strengthens the gambling environment on which our sport depends,” said Tanner. “By restoring the full deduction for betting losses, this legislation supports everyday gamblers, protects the opportunity and ensures pari-mutuel betting remains competitive in a rapidly evolving gambling market.”

The legislation is particularly important for the horse racing industry, where betting is the backbone of money generation, economic activity and the viability of racetracks across the country. It protects gamblers because it reinstates the long-standing 100% deductions that fully offset betting winnings. The 90% limit allows them to still be liable for tax on non-profit income and maintains a fair and predictable tax structure.

The USTA remains committed to advancing legislation that strengthens betting integrity, protects participants, and improves the long-term health of the running industry nationwide.

The legislation was introduced by Rep. Barr during the 119th Congress (2025-2026).
