Tesla wins summary judgment against an Indian company for using a trademarked name

The Delhi High Court has granted an interim injunction in favor of US-based Tesla Inc by directing Indian company Tesla Power India not to use the trademarks ‘Tesla Power’ or ‘Tesla Power USA’ in any form, including the production of electric vehicles.

The court passed the interim injunction and noted that a declaration has been made on behalf of defendants – the Indian company – that they have no intention of manufacturing electric vehicles (EVs) at all and that they will not market EVs of other entities under the trademarks ‘Tesla Power’, ‘Tesla Power USA’ or any other brand that is deceptively similar or use the word ‘Tesla’ until the final judgment in the suit.

“The above statement also applies to directly or indirectly using, soliciting, providing services and advertising, including on the Internet and e-commerce platforms, and selling or trading lead-acid batteries for all types of automobiles, inverters and UPS,” the court said.

Judge Tejas Karia said plaintiff Tesla Inc, whose CEO is Elon Musk, has made a prima facie case for granting an interim injunction and has proven its prior user, goodwill and reputation.

“An injunction is a relief of equity and in the light of the argument the same holds in favor of the plaintiff and against the defendants. Further, the balance is also in favor of the plaintiff and against the defendants and serious prejudice is likely to be caused to the plaintiff if the interim injunction, as prayed for, is not granted in favor of the plaintiff and against the defendants,” the court said in its 52-page order.

The court’s order was passed on November 24 and made available on the website on the evening of November 26.

Tesla Inc. had approached the court for a permanent injunction to restrain Tesla Power India from using the trademarks ‘Tesla Power’, ‘Tesla Power USA’, its logos and related domain names.

Tesla Inc, relying on its previous registrations and extensive international use of the TESLA trademark, argued that the Indian company’s marks prominently feature the word ‘TESLA’, creating a likelihood of consumer confusion.

The court also found that the Indian company appeared to be taking advantage of Tesla Inc’s reputation, particularly by adopting the name ‘Tesla Power USA’.

It said this name “appears to be intended to mislead customers into believing that the technology used by the defendants originates from the US and that they are associated with the plaintiff, which is based in the US.”
