The court case claims that Tesla had the legal duty to warn the claimant after the vehicle had been sold about supposed defects in the vehicle, but Tesla claims that the liability theory is not available in Texas.
According to the Automaker: “The Texas courts have specifically kept that there is no duty after the sale to warn or remember an alleged defective product.”
Tesla argues that the lawsuit must be rejected because the Tesla model Y 2023 has met all federal and national vehicle regulations when it was manufactured and sold, so the claimant’s claims are federally advanced.
Moreover, the automaker insists that all claims are excluded by a lack of jurisdiction because the state is the most important relationship to this court case Virginia, where the crash took place.
And Tesla demands a jury court to prove the crash and any injuries or damage were the result of “negligent actions” that go beyond Tesla’s control and caused by others, including director Venkateswara Pasumarti.
