The Supreme Court destroyed a FIR registered on Friday against a non-resident Indian (NRI) accused by a woman of rape under the pretext of marriage. The top court noted that the man withdrew from the marriage because of the “aggressive sexual behavior and the obsessive nature” of the woman.

The court said it false and not substantiated the allegations of the woman, and said that the continuation of the persecution against the man would be a “travesty of justice”.

“In our opinion, the accused appellant was absolutely justified in panic and withdraw from the proposed marriage in getting to know the aggressive sexual behavior and the obsessive nature of the de-Facto complainant,” said the Supreme Court bank as he expressed the order.

It indicated the order in a case in which a woman received several FIRs against the man, who had come to India after he was connected to her online through a wedding location.

The woman had claimed that the man had forced her to have sex, to promise her marriage and then to submit a fir again in which he claimed that he had refused to marry her because he was a planned caste.

Based on the intersection of allegations and counter-appeals, the court noted that allowing the prosecution of the accused, who made a plea to destroy FIR against him that he would be falsely involved, would be a “travesty of justice”.

The Tophof further said that the FIR was nothing but a bundle of lies and was full of “manufactured, malignant and non -supported allegations” Geneclas by the complainant.

“The registered facts clearly determine the complainant’s vengeful and manipulative tendencies and these aspects have a major influence on the controversy,” it added.

The bank also took knowledge of the WhatsApp chats of the woman, where she admitted that she was manipulative and tried to “get a green card holder”.

“These chats show the grim reality of the behavioral pattern of the de-facto complainant, which seems to have a manipulative and vengeful tendency,” the court noted.

Furthermore, the court noted that the woman had filed a similar complaint about rape about the promise of marriage against a university professor.
