Despite the lawyers and supporters of Erik Menendez who emphasize his university diploma and volunteer programs in their attempt to release him, a commissioner for the state administration said that Thursday’s behavior in prison has contributed to the decision to refuse his conditional release.
While Los Angeles County District Attorney Nathan Hochman spoke of Menendez on a mobile phone in prison when he opposed their resentment, other violations were discussed during Thursday’s hearing.
“Unlike the beliefs of your supporters, you have not been a model prisoner, and to be honest, we find that a bit disturbing,” said conditional commissioner Robert Barton.
There were at least three fights or vocationals in which Erik Menendez was involved as revealed during the hearing.
After he had argued with “Mr. Brown” in November 1997, Menendez had a physical fight with “Mr. Farmer” after he had been moved to Richard J. Donovan Correctional Facility.
“I was guilty of mutual fighting. I fought back,” said Menendez, claiming that he had to fight in self -defense.
When the tax fraud was questioned in 2013, he explained that he had to commit the tax plan because he was threatened by a prison gang.
“I was a huge fear,” said Mendez, claiming that one of his prison friends was stabbed and raped by the gang. “This was a great opportunity to coordinate and survive myself.”
In February 2018, Erik Menendez also turned out to have invited someone in his cell to smoke Marijuana, with the prisoner answering that he had received the medicine from the same prison gang.
He also referred to heroin in 2018, and added that he was “allergic” for the medicine.
In addition to his drug use, Menendez was found with stocks to make prison wine in his cell, the hearing revealed.
Menendez explained that although he did not really care about alcohol, he said the violations had been committed because he was “miserable” and felt hopeless “in prison.
The Commissioner also interviewed the prisoner about a few incidents with his wife, Tammi, with at least one event with his stepdaughter.
After Menendez was found in the prison chapel for ‘excessive physical contact with the visitor’, Menendez turned out to have close physical contact with his wife, because his then-9-year-old stepdaughter was in the same room.
“I occasionally pushed the line into the visiting room with my wife because I was attracted to her, and we had sexual feelings for each other, and we had no way to really express them,” Mendez explained while they claimed they did not take sexual activity. He said the girl read a book while the couple ‘nestled’.
While other less serious violations include art supplies and wax candles and spray paint in the cell, Barton finally said that his institutional misconduct showed a lack of self -consciousness. “
