One of the 39 witnesses that became hostile in the Malegaon 2008 Blast Case was Milind Joshirao, Trustee of the Abhinav Bharat Trust, who also led a lift company.
Joshirao told the court that ATS -officers Shrirao and Param Bir Singh threatened to torture him and forced him to name Uttar Pradesh Chief Minister Yogi Adityanath and other RSS officials.
He was picked up by the ATS on October 28, 2008, almost a month after the explosion, and remained in custody until November 7, 2008. He was held at the ATS office for more than seven days.
Despite the fact that he witnessed the persecution, Joshirao did not support the claims for which he was brought to court, namely the motive behind the formation of the ABHINAV Bharat organization, reportedly set up by serving Army Officer Lt. Col. Prasad Purohit.
According to the Public Prosecution Service, a meeting was held in June 2006 in Raigad Fort, attended by Purohit, businessman Ajay Rahirkar, Rakesh Dhawade and various witnesses, including Milind Joshirao. Dhawade was fired by the special court before the trial started.
The persecution claimed that the idea of forming Abhinav Bharat was created by Purohit and was discussed during the Raigad Fort meeting. Allegedly, all those present agreed with the proposal and took an oath in the fort to set up ABHINAV Bharat and to work on their objectives.
The ABHINAV Bharat Trust was formed in 2007, according to the persecution.
It was also claimed that the accused India wanted to transform into a ‘Hindu Rashtra’ called ‘Aryavart’. Dissatisfied with the Indian constitution, they would reportedly intend to create their own, to form a government in exile and train individuals in guerrilla warfare.
The group is said to be planning to eliminate those who oppose the formation of a ‘Hindu Rashtra’. Purohit was accused of collecting RS 21 Lakh to finance these objectives.
Special public prosecutor Avinash Rasal Cross Severage Joshirao after he had been declared hostile by the court. Even during cross -hearing, however, Joshirao did not make any statements that supported the case of the prosecution.
He specifically denied attending the Raigad Fort meeting or that an oath was taken to create a separate ‘Hindutva Vadi Rashtra’.
Instead, he stated: “Ats treated me as an accused and kept me in their office for seven days. The officers put me under pressure to name five RSS individuals, including Yogi Adityanath, Indresh Kumar, professor Devdhar, Sadhvi, Sadhvi, in Statement. Right Lahoti.
The judge also noted that the Joshirao statement “was only included/recorded by an ATS officer.”
In view of his testimony before the court, the judge stated: “It clearly states that the statement was involuntary. Even if the content of such a statement is proven by the research officer, it can still be insufficient because it increases doubts about the admissibility and authenticity of such an involuntary statement.”
