Equifax settles lawsuit over fair credit reporting

The lawsuit was initially called Equifax, Automobile Club of Southern California, America’s first credit union, Adler Wallach & Associations, Citibank, Wells Fargo Bank, Thrown And Bridgecrest Acceptance Corp. as defendants. Xactus was dismissed from the lawsuit in September 2025, after receiving a favorable ruling on his motion to dismiss. Citibank and the Automobile Club of Southern California were also dismissed from the lawsuit, but they were brought back in after being named as defendants in Guo’s second amended complaint filed in mid-November 2025. Xactus was not named in the amended complaint.

In the second amended complaint, Guo alleges that after she became a victim of identity theft, the Financial Institution and Credit Bureau Defendants continued to report and attempt to collect fraudulent debts after she provided evidence of the fraud. In doing so, she claims that they violated federal and California consumer protection laws by failing to properly investigate and correct her credit reports. As a result, Guo claims her credit score has been damaged, causing her to pay higher credit costs.

Specifically regarding Equifax, Guo alleged that the company failed to conduct a reasonable investigation into the dispute she filed, negligently and intentionally damaging its credit rating.

The remaining defendants in the lawsuit have all filed motions to dismiss the second amended complaint. These requests are currently being considered by the court.
