— A Volkswagen turbocharger settlement has received final approval after more than three years in court.
Plaintiff Julie Kimball sued more than three years ago after her 2010 Audi A4 developed turbo problems after its warranty expired.
She says it cost her about $3,000 to replace the turbocharger, and although the bulk of the class action was dismissed in 2023, the judge allowed the plaintiff to amend and refile her lawsuit three times.
The settlement has now received final approval from the judge, although Volkswagen denies all claims and allegations in the class action.

Some vehicles are 16 years old and a customer may still pay half the cost if they meet the requirements regarding ‘Proof of Compliance with Maintenance Requirements’.

Warranty extension
The class action settlement says there is a turbocharger warranty extension for current owners and lessees, but it only applies to Generation 3 vehicles. And Generation 3 customers will still have to pay 50% of the cost, but only if the turbo fails because the wastegate fails due to corrosion of the fork head and/or shift pin.
The warranty extension for the VW turbocharger is valid for a maximum period of 8.5 years or 135,000 kilometers from the moment the vehicle was first put into use. This means that some older vehicles may have had their extended warranties expired before the settlement was finally approved.
If the Turbo warranty extension has expired on an older vehicle, the extension will last 60 days from the date of settlement, or 85,000 miles from the vehicle’s in-service date, whichever comes first.
Replacement compensation
This applies to Generation 1, Generation 2 and Generation 3 vehicles and offers a 50% expense reimbursement.
Customer must have paid for turbo repairs or replacements by the class action settlement notice date and within 8.5 years or 85,000 miles from the date the vehicle was first placed in service.
For a Generation 1 or Generation 2 vehicle, the past turbocharger repair or replacement must have been solely due to the wastegate no longer functioning properly due to wear and tear on the connection plate and pin.
For a third generation vehicle, the past paid repair or replacement of the turbocharger must have been solely due to the wastegate failure due to corrosion of the fork head and/or connecting pin.
The plaintiff will receive $3,500 and the attorneys representing her will receive $1,950,000.
The Volkswagen Turbochargers class action lawsuit was filed in the United States District Court for the District of New Jersey: Julie Kimball v. Volkswagen Group of America, et al.
The plaintiff is represented by Kantrowitz, Goldhamer & Graifman, PC, and Thomas P. Sobran PC.
