A sessieshof in Mumbai has acquitted five women, all housewives in the thirty, accused of attacking police staff on a police station, referring to unreliable police and lack of affirmative evidence.

The case dates from May 2015 when a dispute broke out between two groups of women within the police station of Bhandup. Initially, three women arrived around 10:20 pm to file a complaint against four others for abuse and abuse. A non-cogisable complaint was registered and the women were asked to leave.

Later, around 12.30 pm, two women from the opposing party arrived to incite a complaint.

While the second complaint was submitted, the three women from reportedly reported again within the police station and began to abuse the second party. A verbal fight between the two groups quickly escalated in a physical confrontation.

At the time, police officers present, including Mangala Shripati Patil and Sonali Madane, were reportedly attacked while they tried to intervene, and both were injured.

A case was submitted against the five women under sections 160 (Affray), 353 (attack on civil servants to scare them off) and 34 (common intention) of the Indian Code of Criminal Law. Four police personnel testified in court.

The judge, however, noted from Madane’s statement that at the time of the incident there were 10 to 12 police officers employed and asked: “If so, how they could not only have five ladies control. It is hard to believe that only five ladies overwhelmed 10 to 12 police officers and attacked them.”

Additional sessions Judge VG Raghuwanshi said that the testimonials of the police personnel were “not reliable”.

Further research revealed critically expired in the investigation. The investigative officer, who was described by the court as a ‘interested witness’, had not collected CCTV images of the station.

Moreover, a medical officer who investigated the injured agents who were admitted during the cross -hearing that the medical certificates did not miss the history of the injuries, making it unclear whether they were related to the incident in question.

The judge also noted that although the police had claimed to register statements of independent witnesses, none were investigated during the trial. “Non-investigation of witnesses of prosecution is a material error in the prosecution and it cannot be loaded with this count,” the judge stated.

The court was rejected and ruled that the testimonials of the police personnel were not credible. “If the prosecution is only dependent on testimonies from the police witnesses, their testimony of Sterling’s quality should be … conviction cannot be based on such non -corrected and unreliable testimonies,” concluded Judge Raghuwanshi.
