The Ansal Heights families of Gurugram are taking action against the builder

GURUGRAM: Over 300 families living in Ansal Heights in Sector 92 have appealed to the department of urban and rural planning (DTCP), Haryana, demanding urgent intervention after they alleged that the housing project has been occupied for almost a decade without a mandatory occupancy certificate (OC).According to a statement issued by residents on Sunday, the developer started offering built-in properties in 2015, assuring buyers that the OC would be obtained within six months. However, nearly a decade later, the certificate has yet to be obtained, raising concerns about safety, legality of occupancy and regulatory enforcement.

A certificate of occupancy is a legal requirement that confirms compliance with approved construction plans, safety standards and regulations. In the absence of the certificate, residents say they face legal vulnerability, possible fines and difficulties in obtaining individual electricity and water connections. They also identified issues relating to property registration, resale, home loans and compliance with fire and structural safety standards.

Residents claimed they were repeatedly given assurances over the years, but no clear timeline or transparent update on the OC application has been shared.

They stated that despite paying the full purchase price, including maintenance and legal fees, they continue to live in uncertainty because the developer has not completed the legal formalities.

“This is not just a contractual dispute; it is a matter of public safety and governance. Hundreds of families cannot remain in legal limbo for years while authorities look the other way,” one resident said in the statement.

The residents have demanded immediate disclosure of the status of the certificate, a binding and time-bound obligation to obtain it, and accountability for the lengthy delay and what they describe as misleading assurances. They have urged DTCP and the Haryana Real Estate Regulatory Authority (RERA) to enforce compliance and ensure early resolution. The residents said they will take legal action if the issue remains unresolved. The developer could not be reached for comment.
