The Allahabad Supreme Court recently noted that a Muslim man has the right to get married several times as long as he treats all his wives right. The court underlined that polygamy was allowed for a “valid reason” for a “valid reason”, but is “abused” by men for “selfish reasons”.
A single Bank of Justice Arun Kumar Singh Deswal made the comments as he heard a petition to destroy the accusation, knowledge of the Chargesheet, the knowledge against a man, Furkan, published by a court in Moradabad.
The case dates from 2020 when a woman filed a complaint against Furkan because he reportedly marry her without informing her that he was already married to another woman. She also claimed that Furkan raped her during their marriage. After this, a case was submitted to the Moradabad police station and were issued to three accused people, including Furkan and two other people.
The lawyer of Furkan argued in the court of Moradabad that the woman had admitted that she married Furkan after having had a relationship with him. He also argued that the second marriage should be invalid to attract offense at Section 494 of Indian Penal Code (IPC) – marry a person while he is already married to another.
Justice Deswal, as he argues for the Uniform Civil Code (UCC), said that the man did not commit a crime because a Muslim man can marry a maximum of four times. He also said that there is a historical reason behind the Quran that allows polygamy, and added that all issues with regard to marriage and divorce must be decided according to the Shariaat Act, 1937.
The Supreme Court of Allahabad said in his 18 -page judgment that the second marriage of Furkan is valid because both women are Muslims.
The court included the issue for the next hearing on 26 May.
