Pune: The district has 1,244 projects that cannot entertain new bookings or sale, because Maharera has marked them ‘Under Awayance’ – which means that they have not received completion certificates or have requested the Deadline extensions. The hard -earned money from many individuals continues to get stuck.
Eleven 11 years later, a Pune IT professional has to get his flat still in a project on the foothills of Sinhagad. Despite a number of Maharera orders in his favor, the project is not completed, nor has he received a refund. The project is now under deviation on the Maharera website, so that new bookings and sales are stopped.
The buyer was one of the first to invest in the project that was not even completed 20%. “My money for RS30 Lakh is fixed. The builder shows no intention of completing the work. I have now stopped following up now, because nothing moves.”
Another buyer in the same project with three construction said that the association has filed many complaints with Maharera over the years. “The first order of 2017 directing completion by 2018. The project received another extension until October 2020 and March 2025 after that. The work has not even started so far,” he said, adding that his RS16 Lakh is stuck.
And such cases are not isolated, they said.
Maharera has included 4,904 real estate projects under deviation in Maharashtra. Pune District has no less than 1,244 of such projects, followed by Thane (548), Raigad (473), Mumbai Suburban (441), Nashik (250) and Nagpur (247).
Maharera -officials said that projects were not completed or extended retails not submitted despite continuous memories. “We have issued notifications to the developers and have given them sufficient time. The projects that do not comply with may not register a new sale or agreement. The project bank accounts are frozen,” they said. The State Property Registration department was also sent the list of stalled projects to prevent further transactions.
Consumer organizations have now demanded strict action. “Buyers cannot execute the deed of sale unless the completion and the occupancy certificates are uploaded. Their partial payment is retained for an indefinite period,” said an activist for consumer rights, which encouraged Maharera to process repayments in cases of persistent non-compliance.
It is common for builders and buyers to follow an agreement for sale, followed by a deed of sale after the construction has been completed and payments. The SALE agreement outlines general terms and conditions and promises certain facilities, while the deed of sale is legally switched.
In the meantime, the body of developers acknowledged the problem, but said that delays were also due to delay in the update of the website. “Many developers have already uploaded their completion certificate (CC), but the Aweyance tag remains. We have recorded this,” says Sunil Furde, the national executive power of Credai.
To ask anonymity, a developer said: “I uploaded the CC more than a month ago, but it still does not reflect. Such a delay hurts both developers and buyers.”
RERA ACT says that developers are instructed to upload both starting and completion/occupancy certificates to guarantee transparency and buyer protection. Maharera data showed that only 17,413 of the 50,986 registered projects in the state were fully marked.
