Liberals to start legal steps on election result in Sydney seat from Bradfield

The NSW Liberal Party will challenge the federal election result in the Sydney seat of Bradfield after he has lost it to Teal Independent Nicolette Boel.

In a statement on Monday evening, Liberal Giselle Kapterian said that the decision to go to the “referee” was to ensure that the final result reflected the “true wishes of the voters”.

“More than 118,000 ballot papers were issued by the people of Bradfield. The original count resulted in an eight votes lead in my way,”

she said.

“While the second count resulted in a 26 votes ahead for Mrs. Boele. Today’s decision is made to ensure that the intentions of the voters of Bradfield are accurately reflected in the final count.”

She added that this step would “offer collective confidence” and “any remaining doubts created by the two conflicting counts” remove “.

However, she also pointed out that the move was not about doubt about the election system.

“To be clear, there is no doubt about the integrity of our election system.

“In fact, this process has only served to re -confirm my belief in the democratic institution of Australia.

“I am grateful for the AECs [Australian Electoral Commission] Tireless work when delivering the two very narrow counts. “

Mrs Boele was named the winner on 4 June, more than a month after the voters went to the polls.

The challenge will be brought before the court of disputed returns. The Supreme Court of the Supreme Court would propose a High Court or Federal Court Judge to sit as a court of disputed declarations.

Weeks of uncertainty

After weeks of uncertainty, Mrs. Boele defeated Mrs. Kapterian with only 26 votes, with every woman liding on different points in the electorate.

Mrs. Kapterian published a statement shortly after her opponent had declared the victory and promised to “carefully revise the two counts”, leaving the door open for a legal challenge.

The historic Blauw-Ribbon seat was initially called for Mrs. Kapterian on 12 May by the ABC’s main election analyst Antony Green, when she led for around 200 voices.

But as the count went, the number of votes between the couple, and a week later Mrs. Boele took the lead as the provisional winner.

Mrs Boele remained for 40 votes after the unofficial distribution of the preferences, but when the counting came in the last phases, Mrs. Kapterien continued with eight balloters.

According to the policy of the Australian Electoral Commission, a recount was ordered, as is the case in all competitions that are won with fewer than 100 votes.

In an interview with ABC’s afternoon briefing in June, Mrs. Kapterian said that she was not having to hurry in a legal game.

“It is the two different results that we are looking at now, take a moment to breathe, take advice … to really understand where the numbers are and what awaits us,” said Mrs. Kapterian.
