In a brief opinion to the joint committee on November 28, the legal panel said the bill falls within Parliament’s power to make laws that do not require ratification by states.

The short advice is a follow-up to a detailed advice that the Legal Committee gave to the parliamentary panel in October.
The new document was presented to the parliamentary committee ahead of its meeting on Thursday (December 4, 2025), when Chairman of the Law Commission Justice Dinesh Maheshwari (Retd), Member Secretary Anju Rathi Rana and Joint Secretary Varsha Sinha will brief the members on the finer legal points.
The Joint Committee of Parliament is examining bills on holding simultaneous elections to the Lok Sabha and state assemblies.
The law panel said the proposed amendment does not in any way disturb the basic structure of the Constitution.
“…the Law Commission is clearly of the opinion that any reduction in the term of office of the House of Representatives through the proposed amendment does not violate the basic structure of the Constitution,” she stated.
On the issue of federalism, the committee said that federalism as envisaged and articulated in the Constitution of India does not mean compartmentalization of different units; rather, it is the interweaving of different units with a strong Center as the pivot.
