Karnataka RERA will tell builders to specify exact parking spaces in the sale agreement

BENGALURU: Amid complaints from homebuyers over unclear and varying parking permits, the Karnataka Real Estate Regulatory Authority (K-Rera) will make it mandatory for builders to disclose the number, size, type and exact location of parking spaces in allotment letters and sale agreements.“We are in the process of finalizing it,” K-Rera chairman Rakesh Singh told TOI. The regulator is in active consultation with Credai, the apex body of private real estate developers, and has brainstormed with representatives of some of the city’s top real estate companies.

“Clear identification of parking spaces in apartments ensures that allottees are fully aware of what is being sold or allotted along with the flat. The primary purpose is to protect home buyers from misleading statements and incomplete disclosures,” sources said.

The regulator relied on the precedent of the Maharashtra Real Estate Regulatory Authority (MahaRERA), which had been following a similar disclosure regime since 2024, reducing litigation over parking rights.


Home buyers have welcomed K-Rera’s parking campaign

The Karnataka Real Estate Regulatory Authority (K-Rera) has finally blinked and will soon make it mandatory for builders to mention parking spaces in allotment letters and sale agreements – a problem that has long been noticed by apartment buyers who have parking space-related disputes with builders.

This also addresses accessibility-related issues and security and usability issues. As per the proposed rules, a builder must specify the exact number of parking space, type, size with dimensions and location of parking space to be allotted to the allottee by mentioning the same in the allotment letter and in the sales agreement document. The regulator says: “The parking layout plan, duly approved by the relevant planning authority and clearly setting out parking details, must be attached to the sales agreement.”

“We were promised a covered parking space, but at the time of possession, we were shown a completely different space that could barely fit our car,” said Anirudh Rao, a homebuyer in Yelahanka. “There was nothing in writing – no dimensions, no marked location – so we had to accept it.”

Accessibility issues also emerged as a major problem. Ramachandra Rao, a resident of Kanakapura Road whose wife is physically challenged, said he had been struggling with parking issues for over five years and approached K-Rera for help.

“My apartment is in Tower G, but the parking space assigned to me is almost two blocks from the elevator,” he said. “There is no ramp at the entrance to the lift and I have to push my wife’s wheelchair for a long distance and then lift her over a step. I am elderly myself and that has become quite a challenge. When I requested the builder to allocate a parking space closer to the lift or to provide a ramp, he simply refused.”

Other buyers pointed out security and usability issues. “In our project, the allotted parking space is between two pillars, making it almost impossible to fully open the car doors,” said Sunita Menon, a resident of a gated community on Sarjapur Road. “We only realized this after we took possession. The builder says the lock was ‘according to plan’, but the plan was never shared with us.”
