Erik Menendez back in prison after he was admitted to the hospital with kidney stones

Los Angeles – Our sister station, ABC7 Eyewitness News in Los Angeles, has learned that Erik is from the hospital and is back in prison.

The Department of Corrections and Rehabilitation says that the 54-year-old was admitted to hospital last month with kidney stones.

Erik and his brother Lyle have a planned conditional hearing at the end of this month.

The brothers were convicted of killing their father, Jose Mendendez – a powerful record manager – and their mother, Kitty Menendez, in their house in Beverly Hills in 1989. While defense lawyers claimed that the brothers from self -defense acted after years of sexual abuse by their father, agreed for a multimion -dollar.

Their first tests resulted in hung juries. During the second trial for both brothers, the judge excluded a substantial amount of evidence, including testimonies from various family members who witnessed or heard of the abuse. The brothers were convicted and convicted of prison without a conditional release.

In May, a judge reduced his penalties for up to 50 years to life in response to a resentful petition, which makes them eligible for conditional release.

The new evidence included a newly discovered letter from Erik Menendez to his cousin Andy Cano in which he describes that he is being abused by his father, and a statement by Menudo Boy Band -member Roy Rossello that he was raped by Jose Mendez in the 1980s.

While prosecutors argued that the evidence was early and not -inadmissible, Ryan chose the side of the Menendez brothers and said they had provided sufficient evidence why the evidence could have changed the outcome of their beliefs.

Governor Newsom has not commented on the incident.

Under Clemency, Newsom can release the brothers at any time.
