Nan Deblase sued a man for compensation after he witnessed her son’s dog when he drove past a stopboard
Dogs with pets are usually seen as family members for some people, and now, after a recent decision by the New York judge, the courts do that too.
According to The New York PostA Brooklyn judge ruled In favor of Nan Deblase, who sued a driver who ran over her son’s dog in 2023 for emotional need after witnessing the death of the pet. In most cases, pets are considered possessions, but Judge Aaron Maslow of the Supreme Court stated that Deblase was entitled to compensation because of what she went through when she chews the driver, Mitchell Hill, her pet, mowing, Duke, Duke.
The incident took place on July 4, 2023, when Deblase ran with her son, Trevor’s, Dog. She walked with Duke when Hill went through a stopboard and the dog hit while Nan got out of the way.
“It is reasonable for a jury to conclude that witness Van Duke who is crushed led to emotional need that goes beyond what is generally felt by the loss of purely ownership,” Maslow wrote in his decision in June.
“This court does not see why a beloved companion pet cannot be considered as ‘direct family’ in the context of the zone of the Danger doctrine under the facts presented by the claimants.”
When the tragedy took place, Trevor posted the incident on his social media account.

Nan took Hill to court to repair compensation after challenging an “outdated” law that allocated them to sue hills for the market value of Duke, plus medical costs – around $ 2,000.
“Since Nan Deblase was tied to Duke at the time of the accident,” Las Maslow’s decision, “It is appropriate for her to repair compensation for emotional need as a result of witnessing Duke’s death and fear of her own safety, all because of the negligent, indeed reckless, operation of his vehicle.”
Deblase will again have to appear before the court to learn how much the family will recover before the incident.
