Delhi High Court bars Patanjali from airing a Chywanprash advertisement; help for Dabur India

In a relief to Dabur India, the Delhi High Court has issued an interim injunction restraining Patanjali Ayurved and its subsidiaries from airing a recent advertisement labeling all other Chyanwanprash products as “Dhokha“, as it amounts to “commercial contempt”. The court will next hear the case on February 26.

It has also directed Patanjali Ayurved to remove, block or disable the disputed advertisement from all electronic media including TV channels, OTT patrols and digital media within the next 72 hours.

Dabur India has argued that Patanjali Ayurved has made “malicious, gross and deliberate misrepresentations”, denigrating or defaming classical Ayurvedic medicine, i.e. the entire class of Chyawanprash in general, in the marketplace, constituting general denigration and contempt.

“A at first glance a case has been filed on behalf of the plaintiff (Dabur India) for grant of a ad interim command. The balance of convenience favors the

Plaintiff and against defendants (Patanjali Ayurved). Irreparable injury would be caused to the plaintiff if: ad interim No order is granted,” the court ruled

Dabur India is the market leader in the Chywanprash segment with a market share of 61 percent.
