New Delhi: Fair Trade Regulator CCI has rejected a complaint that has rejected the abuse of dominance and anti-competitive practices by Emaar India LTD and others in connection with his “Marbella” Villa project in Gurugram.
“The committee notes that there is no great facie case of violation of the provisions of sections 3 and 4 of the law made against the opposite parties at the moment that an order has been adopted by the Competition Commission of India (CCI).
Sections 3 and 4 relate to competitive similarities and abuse of dominant position respectively.
The case was based on a complaint submitted by an informant who claimed that Emaar India Ltd, her group company Emaar India Community Management and various government services, including the Ministry of Town and Country Planning, Haryana and the Union of India via DPIIT, the sections 3 and 4 of the Competition Act.
The complainant claimed that Emaar abused his dominant position by allowing the construction of building floors and non-villa residential units at 97 suddenly within zones 1 and 6 of the project.
The villas were originally promoted as part of an exclusive ‘characteristic villa community’.
According to the complainant, this was contrary to obligations in brochures, copper agreements and transport deeds, which projected a homogeneous luxury villa society.
It was also claimed that the introduction of building floors imposed the uniform design and exclusivity of the project disrupted, unfair circumstances on existing Villa owners and came down to the abuse of dominance under section 4 of the law.
CCI noted that various major developers such as DLF, Godrej, Tata Housing, Signature Global and Vatika Group were also active in the villa segment and alternatives to consumers offered.
However, the supervisor believes that Prima Facie OP-1 (Emaar India PVT LTD) does not seem dominant in the relevant market of ‘offering services for development and sale of villa in Gurugram’.
In the absence of Dominance of Emaar India in the relevant market, there is no requirement to investigate the accusations of dominance abuse. That is why there can be no case of abuse of dominance in terms of section 4 of the law.
The competitive quote is of the opinion that no case can be submitted to these entities under the provisions of the standards, the supervisor said.
