BXP and CBRE belong to the defendants in an unlawful death case with an accident that led to the death of an 88-year-old outside St. Peter’s Church in Midtown Manhattan.
Toni Cohen’s daughter brought a lawsuit last week in the state of Supreme Court in New York about the accident, Crain’s reported. The lawsuit claims that the church at 619 Lexington Avenue and its contractors were negligent in the death of Cohen, so that the “recurring” issues with a lift were not corrected.
In December, Cohen used the lift that offers access to the church on the corner of Lexington Avenue and East 54th Street. When the locking of the elevator reportedly failed, Cohen fell backwards according to the court case and the door opened. Cohen is said to have contracted “serious and permanent injuries” that led her death later that day.
Victoria Cohen, Toni’s daughter, is looking for damage, costs for the funeral and compensation of her mother for mental and emotional fear. Her suitability for the latter could depend on whether or not Toni was consciously suffering between the time of the accident and the time of her death.
Other defendants in the case are the church itself and Otis Lift. BXP and CBRE, charged with managing the property, did not respond to a request for comments on Crain’s court case.
Three consecutive years, the legislative power of the state of New York has approved the New York Rieving Families Act, which could offer families the opportunity to request compensation for emotional suffering in unlawful death cases. Government Kathy Hochul has repeatedly pronounced a veto for the bill, stating the concern about how the bill could increase the insurance costs and destabilize the health care system.
Hochul investigates the last iteration of this legislation, which has adopted both the state meeting and the Senate.
