Brian Flores’ NFL discrimination lawsuit over “racist” hiring practices will likely go to trial


The ruling rejects the NFL’s appeal to handle the case privately.


The discrimination lawsuit against the NFL, led by former Miami Dolphins head coach Brian Flores, may now go to trial.

A federal judge in the case has found that the lawsuit over the NFL’s alleged racist hiring practices could bypass the league’s arbitration process. According to AP News, Flores, a Black man, sued the league along with two others in February 2022 following his dismissal from the Florida franchise.

Although Flores found a new footing in the league, currently posted as defensive coordinator for the Minnesota Vikings, he and other disgruntled coaches spoke out about the unfair treatment of black coaches. Although the NFL initially tried to keep the legal battle private and filed its appeal with the Supreme Court, Judge Valerie Caproni of the Southern District of New York ruled that the case could have a public trial.

Flores’ legal team released a statement expressing gratitude for the court’s decision and saying open court will provide a “fair, neutral and transparent forum” to shed light on this issue.

“The court’s decision recognizes that an arbitration forum in which the defendant’s own principal decides the matter would deprive employees of their legal rights,” Flores’ attorneys Douglas H. Wigdor and David E. Gottlieb said in a statement. “It is long overdue for the NFL to recognize this and finally provide a fair, neutral and transparent forum in which these issues can be addressed.”

In the original lawsuit, Flores alleged that several NFL franchises had not hired black coaches in good faith, calling the process “rife with racism” that led to apparently unwarranted or quick firings. The Dolphins let him go after a 24-25 record over three years, although Flores did have consecutive winning seasons with the team.

In addition to the Dolphins, Flores also singled out the Denver Broncos, New York Giants and Houston Texans for racially biased hiring. Other coaches in the lawsuit, Steve Wilks and Ray Horton, also alleged racism in their appointments and subsequent firings by the Arizona Cardinals and Tennessee Titans, respectively.

The NFL also did not hire any new black coaches in the postseason confirmed by The Athletics. Only three Black head coaches currently lead a team roster. As for the discrimination case, a hearing remains scheduled for April 3.
