The Daily Dirt: Half -baked bureaucracy at State Cannabis Agency

It is a strange day on which a government agency proposes a judicial order that limits itself.

But that is exactly what happened at the Cannabis Management office, in a situation that exposes mism management and incompetence in the heart of the Dispensary outbreak of New York.

New Yorkers often complain about bureaucratic incompetence, but OCM seems to have other agencies beaten.

In his most recent scandal, the office came out and said it had wrongly maintained the law. As a result, 152 planned or approved cannabis pharmacies can have to close or move. Four -like percent of that is in New York City.

It was about how the office had measured the distance between pharmacies and schools and other locations. Instead of measuring the ownership line, as required by law, OCM had measured the pre -entrance.

“When I found out, I was very angry to say the least,” Gov. Kathy Hochul said last month. “That’s a big grumpy.”

A group of affected pharmacies, including non -profit Darling Housing Works, has sued OCM and the Cannabis Control Board to stop the change. A judge denied the motion for a temporarily limiting order without an explanation.

That brings us until last week, when state lawyers for OCM, clearly felt the heat, presented an order that granted the provisional order of the claimants.

“Please order us to go back to the old standards,” the lawyers say in essence. The order was not signed from Friday at 4 p.m.

It is possible that the office negotiates a settlement with the claimants. OCM and its lawyers from the office of the attorney General did not respond to requests for comments.

If you have followed the cannabis rollout for some time, this Saga may not be like a shock. Since its foundation, OCM has difficulty turning mission -driven platitudes into a functioning regime regime.

Last year the State published a destructive internal assessment of the agency. Under the charges: Inexperienced leadership led the agency as a policy startup. The report showed that OCM required many pharmacists to perform a lease agreement or to buy a property to request a license, while at the same time none was planning to revise all the applications that received.

With this last blunder, absent a judicial order or amended legislation, approved pharmacies must move. The governor and the office plan to introduce legislation to solve the problem, but the legislative power is gone until January. And it is uncertain who the legislators will agree.

OCM has offered up to $ 250,000 exemption to affected applicants who have been approved but have not given any definitive licenses.

But in the world of commercial real estate, especially for companies that are contrary to federal legislation, that is not much money. Landlords who take a risk of working with pharmacies usually want premium rent in exchange.

“There are so many things that go to close real estate, especially in New York and in particular in an industry that is so strongly regulated and volatile,” said Fatima Afia, a cannabis lawyer at Rudick Law Group. “$ 250,000 does not really cover much of everything for the people who have already experienced a lot of the process to lock a lease and perhaps to sign a personal guarantee.”
