Supreme Court allows conditional OCs for more than 450 flats in Noida Sports City

NOIDA: The Supreme Court asked Noida the authority to issue conditional occupation certificates for six residential towers in sector 150’s Sports City Project – with an important, albeit the partial victory for more than 450 families waiting for their houses in Godrej Nest.

The order was delivered by a Bank from Justices MM Sundresh and Satish Chandra Sharma, after a petition by Brick Rise Developers – a consortium member of the Sector 150 project led by Lotus Greens Constructions. Brick Rise had challenged a FEB command from Allahabad High Court that against the developers – stating irregularities, delays and unpaid contribution.

The SC Directive requires the authority to grant the conditional occupation certificates (COCS) within six weeks for the six towers whose applications are pending. However, the relief is supplied with closed strings. The certificates are conditional, depending on the outcome of the current special leave requests and further instructions of the SC.

“Conditional occupancy certificates are granted to the applicants within a period of six weeks for six towers for which applications are handled with Noida. Such conditional occupancy certificates are subject to the final result of the special leave requests and all instructions adopted by this court,” the bench observed on Friday.

It is important that the court underlined that the developer must complete all sports and recreational facilities, as originally promised in the context of the Sports City schedule. It also emphasized that all approvals must meet the building regulations and statutes of NOIDA, with possession to follow only after these conditions have been met.

SC also clarified that the Friday order was not a blanket prefunent for other projects in Sports City. “We make it clear that the allocation of conditional occupation certificates to the applicants will not be treated as a precedent in other Allotese in the sports city,” said the court, who limits the scope of the relief. The legal battle has been long and complex.

In February this year, the Allahabad HC ordered a CBI and ED research into developers of three sports city projects – including those in sectors 78, 79, 101 and 150 – about alleged financial and development waste. The HC has also instructed NOIDA authority to issue recovery messages to consortium partners, including those in sector 150, to erase long-term rights. In response, Lotus Greens approached the Supreme Court and led to a residence for a coercion.

The pressure of the authority’s notifications brought various developers, including Brick Rise, to clean up their contribution. Brick Rise Alone Deposited RS 80 Crore, and other partners are expected to follow the example. The deposit paved the way for the command of the Apex Court.

“We welcome the judgment of the honorable Apex Court in favor of home buyers. We have complete faith in the SC and are committed to discharging our tasks,” said a spokesperson for Lotus Greens.
