Push back includes serious problems with regard to life and freedom of a person, says Calcutta HC

The Supreme Court of Calcutta has noted that the issue in which permanent inhabitants of West Bengal are returned to serious problems with regard to the life and freedom of a person and the government of the Union has instructed to submit a sworn explanation that revealed the designated places from which such a group of prisoners were back.

A division bench by Justice Tapabrata Chakraborty and Justice Reetobrata Mitra while hearing a petition submitted by Bhode Sheikh, father of Sunali Bibi who was pushed back into Bangladesh after he had been held in Delhi, said the place of the Detaines was not revealed. The bank noted that in the absence of such details, the issue of territorial jurisdiction cannot be given priority and determine at this stage.

The advice that appears before the Union Government and security authorities have submitted the petition by father of Sunali Bibi for the Supreme Court of Calcutta on the basis of the sustainability. The Supreme Court in his order of 11 September also referred to a statement submitted by the center stating that FRRRO ((Regional Registration Office) of Delhi, as a civil authority, illegal migrants from Bangladesh, was repatriated according to the instruction of 2 May 2025 published by the Ministry of the Interior.

The counselor of the submitter Bhode Sekh, the father of Sunali Khatun, said that, despite repeated efforts since June 2025, he could not make contact with the prisoners (her daughter and other family members) and he submitted a missing dialy on July 6, 2025 for the Paikar police station in the Paikar police station.

Sunali Bibi, her husband Danish and their eight -year -old son were pushed to Bangladesh on 26 June after they were held by the Delhi police. Sunali is eight months pregnant. Last month they were held by the Bangladesh police on accusation of the illegal coming into the country and put in prison.

West -Bengaals Chief Minister Mamata Banerjee has announced an arrangement entitled entitled Shramashree To Give a monthly stipend of £ 5,000 to migrating employees who are forced to return from other states. Mrs Banerjee has said that around 26,000 migrating employees have returned to West Bengal after intimidation of Bengalse -speaking migrants.

On Friday (September 12, 2025), the Trinamool Congress claimed that a Bengalian migrant employee from the Tehatta of Nadia was brutally hacked in Visakhapatnam.

“This is the grotesque expansion of a climate of linguistic terror cultivated by @bjp4india and his allies. When a political project legitimizes exclusion, the marginalization becomes permission to kill,” the Trinamool congress was placed on social media.
