MIKE DAVIS: Why DC’s Trump-hating Judge Boasberg should be impeached

James Boasberg, the chief judge of the United States District Court for the District of Columbia and a Biden appointee, is a judicial disgrace. Boasberg’s recent statements show that he is unsuitable for the bank.

His repeated abuse of the judiciary, whether undermining national security, making violent threats, or enabling unlawful surveillance, demonstrates a blatant disregard for the Constitution and a dangerous partisan agenda that disqualifies him from lifetime appointment.

It’s time for the House of Representatives to do its job and impeach him.

The Constitution states that a judge’s term of office is “during good behavior.” The Constitution also requires that impeachment be appropriate for “high crimes and misdemeanors.” House Democrats argued in 2020 that an official could be impeached for abuse of power even without a statutory crime, setting an important precedent. The Constitution makes no distinction between the requirements for removing officials from the executive branch and the judiciary. What is good for the goose of the executive branch is equally good for the goose of the judiciary, so the House of Representatives should not hesitate to initiate judicial impeachment proceedings.

Boasberg’s first misconduct occurred during a judicial conference. During the early stages of President Trump’s second term, Boasberg expressed the opinion to Chief Justice John Roberts that President Trump would not follow court orders. The president has not violated a court order. Boasberg’s claim had no basis and was clearly biased. Boasberg baselessly told Chief Justice Roberts that Trump would disobey court orders, a baseless partisan claim that undermines any expectation of impartiality.

Tren de Aragua is a barbaric international state-sponsored terrorist organization from Venezuela. MS-13 is an animal gang based in El Salvador. Thousands of these gang members have come to the United States and committed heinous acts. In March, the Trump administration deported hundreds of these barbarians to El Salvador, where they were sent to a maximum-security prison. Boasberg issued a highly illegal and dangerous order ordering the government to turn around planes while they were in international airspace and flying over the Gulf of America. In doing so, Boasberg exposed an ongoing military operation and issued an order that could have endangered the Americans.

Why should we in the United States have security in place to deal with an unexpected influx of hundreds of dangerous terrorists because a fanatical partisan judge just illegally opened his courtroom and stunningly attempted to sabotage an ongoing military operation? Rather, the security footprint was in El Salvador – hundreds of military, intelligence and law enforcement officials – where the terrorists were expected to land. There was also a serious risk to the aircraft’s personnel, as they had a limited fuel supply and were in the middle of the Gulf of America. Boasberg showed blatant disregard for these serious risks by issuing a highly illegal and dangerous order that he had no authority to issue.

The planes landed in El Salvador and Boasberg began contempt proceedings. Even after a D.C. Circuit panel rejected his reasoning, Boasberg pressed ahead and ordered the government to detail its deliberations that day in March. The Justice Department objects, claiming that Boasberg violates the fundamental principle of separation of powers by allowing executive branch officials to illegally make public privileged internal discussions.

Moreover, Boasberg played a key role in Operation Arctic Frost – one of the most dangerous spy scandals in our history. Biden Special Counsel Jack Smith, a political Scud missile sent to take out President Trump through law with the full blessing of Biden and his Justice Department, has subpoenaed the phone records of nearly a dozen U.S. Senators. Boasberg issued a gag order, preventing the phone companies from making the information public for a year. He reasoned without any basis that disclosure could lead to destruction of evidence and intimidation of witnesses. The relevant statute, 2 USC § 6628, explicitly requires disclosure to the Senate when such espionage occurs. Boasberg is now trying to get out of this trouble, claiming he didn’t know Smith was looking for the Senators’ records. Either Boasberg is lying, or he was an illegal rubber stamp who signed whatever Smith put in front of him. It’s disgraceful, and Boasberg, citing the same separation of powers claim used by the Justice Department in its contempt proceedings, refused to testify before the House Judiciary Committee last week.

Finally, Boasberg has shown a light-hearted concern for President Trump’s safety. Nathalie Rose Jones is a deeply disturbed woman. She posted a message on social media threatening to eviscerate President Trump. She admitted that she had accepted the post when the Secret Service visited her. Jones then attended a protest and was seen near the White House with a knife in his hand. Authorities arrested her, and even Democratic-appointed U.S. Magistrate Judge Moxila Upadhyaya, using the most basic level of common sense, ordered her held without bail. Then Boasberg intervened and ignored Upadhyaya, allowing Jones to go home with an electronic monitor.

Boasberg did not simply make a statement that conservatives disagree with. Boasberg has instead engaged in a pattern of impeachable behavior—extremely lawless and dangerous partisan politics—that shows no signs of ending. Braver than ever, he refuses to testify before Congress and happily continues his absurd contemptuous vendetta. The House of Representatives has disgraced itself with two impeachments against President Trump. It is time for the House to redeem itself by bringing reason back to the impeachment process. Boasberg is a more than worthy candidate, and the House of Representatives should impeach him before they go home this year.
