– A class action lawsuit claims Hyundai sold hundreds of thousands of Palisade SUVs with defective side curtain airbags.
The Hyundai Palisade airbag recall class action lawsuit covers 2020-2025 Palisades manufactured between April 10, 2019 and June 16, 2025.
This is another class action that was only filed after the automaker recalled the vehicles to repair them for free.
In this case, the Hyundai airbag lawsuit was filed two weeks after the automaker told the government about the recall of more than 568,000 Palisades in the US.
Hyundai Palisade airbag recall
Hyundai has recalled the third-row side curtain airbags after learning of routine testing that showed third-row occupants are at increased risk of injury in a rollover crash.
The National Highway Traffic Safety Administration found that “the measured displacement of the ejected headform in the third-row seating area exceeded the 100 mm performance limit specified in the standard.”
That “standard” relates to “ejection limitation” for third-row occupants in rollover accidents.
Hyundai, NHTSA and supplier Autoliv were still investigating the cause when the recall for the third row airbags was announced. Hyundai said at the time that it would repair all Palisades for free, but was still figuring out what those repairs would be.
The automaker also said it would reimburse Palisade customers if they had paid out of pocket for previous airbag problems.
The Hyundai Palisade airbag recall lawsuit
The plaintiff alleges that Hyundai knew the Palisade airbags would “fail prematurely and were not suitable for their intended use.”
According to the class action:
“Motivated by the pursuit of profit, Defendant acted maliciously, oppressively, willfully, with intent to defraud, and with reckless disregard for the rights and welfare of Plaintiff and the Class.”
It cost $405 to file the Palisade class action for more than $5 million, but New York prosecutor Kevin Steeneck isn’t claiming his leased 2023 Hyundai Palisade had any problems.
And while recall letters for the Hyundai Palisade airbag won’t be sent out until March 2026 and none of the vehicles have been repaired yet, the plaintiff complains that Hyundai has failed to provide customers with “an effective repair, and that the only safety recall to date has not addressed the underlying problem.”
The class action lawsuit also alleges that Hyundai advertised and sold the Palisades without warning customers about the dangers of the third-row side curtain airbags in rollover accidents. According to the lawsuit, Hyundai should have disclosed the defects when the Palisades were first sold.
And the plaintiff complains that Hyundai continues to deceive and mislead consumers about its airbag defects.
