GURUGRAM: The district town planner (enforcement) has directed the sub-registrar, Manesar, to halt real estate transactions related to Raheja Developers’ commercial project in Sector 84 after it emerged that the project’s license had expired on May 16, 2019.The permit, granted for a commercial colony of 2.3 hectares, was not renewed within the stipulated period, according to an official notice from the Ministry of Physical Planning (DTCP). As per Rule 13 of the Haryana Development and Regulation of Urban Areas Rules, 1976, the permit holder is required to apply for an extension at least one month before the expiry of the extension.
The DTCP order states that the developer has not filed any renewal application even years after the expiry of the permit and that a red entry should be made in the relevant revenue records to prevent any registration of documents relating to the plot.The order also directs the builder to stop all work at the site with immediate effect. Copies of the cancellation order, along with the permit and land scheme, were sent to the Director General, Urban and Rural Planning, Haryana, Deputy Commissioner, Gurgaon, and the Senior Town Planner, Gurgaon Circle.
Officials said the directions have been issued to protect the interests of potential buyers and prevent illegal transactions in projects that do not have valid development permission. “Once a license expires and is not renewed as per rules, any sale or transfer becomes legally untenable. The sub-registrar is required to ensure that no registration takes place in such cases,” a DTCP official said.
The builder’s spokesperson, meanwhile, said they were not aware of the order. “We have requested an extension,” the spokesperson added.
The DTCP’s move is part of a broader crackdown by concerned officials on projects where licenses have expired, mandates have been violated or renewal norms have not been met. “Potential buyers and investors are advised to verify the current licensing status of projects with DTCP before entering into any transaction,” an official said.
