In February, love was accused of crime attack in an incident that occurred in a hotel.
A judge in San Diego ruled this week that there is sufficient evidence to continue with crime attacks against actor and comedian Faizon Love, after an incident in which he reportedly threw a credit card reader at a hotel operator and hit her in the head.
Love, generally recognized for roles in films such as “Elf”, “Friday” and “couples retreat”, is accused of crime attack with a deadly weapon, together with an improvement for inflicting a lot of physical injury. He has not argued guilty.
According to Unpleasant NBC San DiegoThe incident in question took place in August, when Love reportedly became furious after he had heard from hotel staff that the building had no vacancies, despite his booking via an app from third parties. During a provisional hearing, the alleged victim testified that love quickly escalated.
“Mr. Love was very upset. It was zero to 100 very fast,” she told the court. “He repeatedly asked if we knew who he was.”
The woman said she told the love that his behavior was unacceptable before he reportedly pulled the credit card reader off the counter and slid to her. “Mr. Love looked at me directly, took off the credit card machine and threw it in my direction,” she testified.
She sought medical attention hours after the incident and was diagnosed with a concussion. She said she still has persistent effects, including sensitivity to light.
The lawyer of Love, Marc Kligman,, however, doubted the credibility of the testimony, pointing to inconsistencies between the court account of the woman and statements that she made to the police and a 911 -Disphatcher in the night of the incident. Body cameras from the San Diego police were played to emphasize differences.
Kligman also challenged the testimony of two colleagues who said they witnessed the attack. It was admitted that he did not really see the clerk and only heard the sound.
“What the court has to pause … is in the inadequacy of the evidence and credibility of the witnesses,” said Kligman.
He also suggested that the clerk can be motivated by financial gain because she has filed a civil lawsuit to request compensation for medical costs and emotional trauma. “I think there is quite a bit of motivation for her to come up with this, to exaggerate,” Kligman added.
Despite these arguments, judge Rohanee Zapanta found probable reason to continue. Love was presented and a test is planned for January. If convicted, he is confronted with a maximum of seven years in prison.
