On Tuesday, the Supreme Court obliges all states and trade union areas to appoint designation officials designated within six weeks to improve the enforcement of the protection of women against domestic violence (DV).
The bank, consisting of Justice BV Nagarathna and Justice Satish Chandra Sharma, took knowledge of the lack of appointed protection officers in many regions and gave clear instructions for states and UTs to “an officer of the Women and Child Development Department of the Social Welfare Department” to Taluka –
The protection officials are the first contact point for women who are subject to physical, mental, sexual or financial violence within the family. These officers are responsible for guaranteeing appropriate measures, initiating legal proceedings and monitoring safety and well -being of the affected women.
Although the DV Act is in force for two decades, its implementation remains uneven in the entire country.
The issue stems from various states that assign the responsibilities under the DV law to civil servants who have all the Integrated Child Development Scheme (ICDS) treated, including children’s welfare and protection tasks. Senior lawyer Shobha Gupta, who represents the NGO ‘We The Women’, argued that these officers are overloaded and are unable to manage the workload, so that vulnerable women and children are not supported.
“The designation of ICDs or Anganwadi employees as PO will not be enough,” Gupta said.
While various governments of the state have cited logistical challenges, such as recruitment, training and financing as obstacles for naming dedicated officers, Justarathna noted: “Perhaps it is an ideal long -term situation that can be created a framework, but we cannot say that someone else cannot come and help in the meantime.”
The court also ordered the central government and the National Legal Services Authority (Nalsa) to support the enforcement of the law. The bank commissioned the member of Nalsa to coordinate with the authorities of the State and UT Legal Services to make the availability of free legal aid and advice for vulnerable women at the district and Taluka levels known.
