Can my NYC rental company really let me throw my cannabis plants away?

I recently touched my landlord about my two cannabis plants in the front garden of my Brooklyn building. My landlord says I have to finish them, but I thought I could grow cannabis when the laws changed. What gives?

Many New Yorkers can grow their own marijuana in their apartments – but not in building communal spaces.

Last June, New Yorkers had the right to grow at home to three immature and three adult cannabis plants at home. But that new right arrived with various restrictions where Marijuana can be legally cultivated.

Cannabis plants cannot be grown in the common areas of a building, according to the office of the state of Cannabis Management (OCM) Guidelines for housing cultivation. Instead, your plants must be stored in a “safe location” to prevent minor New Yorkers from stealing your flora.

So, unless your front garden is only yours – and walled from your neighbors – your landlord can have your marijuana moved. (And you must do this immediately, given that your current growing regulation violates the law.)

Go where you can grow

You can move your plants in your apartment or to another secure room to which your fellow tenants have no access. Make sure that your plants are not “clearly visible to the public,” says the OCM.

For example, if your apartment has a balcony, you could grow your cannabis there. Make sure your neighbors (and your landlord) cannot see it from the street. If you decide to grow marijuana indoors, the OCM recommends limiting the scent with filters, odor -neutralizing sprays or essential oils.

As long as you have the OCM’s rules, Your landlord cannot forbid you to grow marijuana or to drive yourself, unless you live in social housing or federally subsidized homes.
