Buffalo Supermarket Shooter focused on black people wants federal charges to fall because the jury was too white

On August 14, lawyers argued for Payton Gendron that the federal charges should be withdrawn against their client because there were not enough black people or other minority groups in the jury who sentenced him, with the argument that the constitutional rights of the white supremacist were violated.

According to Gendron’s lawyers, black people, Latinx people and men are “systemically and considerably under -represented” in the lists created from which jury members must be selected.

“To illustrate this point, the big jury that Payton Gendron was charged was drawn from a pool from which about a third of the black persons expected and expected a third of the Spanish/Latino persons,” they argued.

According to assistant US Attorney Caitlin Higgins, the issue is a “technical violation” and it does not matter to the evidence that is necessary to completely reject the indictment.

They continued and claimed that New York City is “far enough of the local media market to be hit less” and, moreover, “the SDNY also has sufficient representation of minorities that is not directly influenced by the shooting and the aftermath of that a diverse and representative jury should be selected.”
