The text of the India-EU FTA released by the European Union on Friday makes it clear that carbon border adjustment measures have no special provision made for India, but it has been assured that if any concession is made to a third country, the same will apply to India.
“Both India and the EU will not apply less favorable terms to the goods of the other Party than those applied to similar goods from other third countries, with regard to the flexibility granted in the implementation of their border carbon adjustment measures,” the text of the FTA said.

Access to services
In the services sector, the pact provides for enhanced market access commitments for sectors such as IT, financial services, telecommunications and professional services, in addition to provisions on the temporary movement of skilled professionals. The chapter on digital trade includes commitments to facilitate cross-border data flows for business purposes, while preserving the right of both parties to set rules for privacy and security. It prohibits customs duties on electronic transmissions and discourages forced disclosure of source code except for legitimate regulatory review. Provisions on electronic authentication and e-signatures are intended to facilitate digital trade, an area of growing bilateral trade.
IP protections
In terms of intellectual property rights, the agreement strengthens enforcement standards covering trademarks, copyrights, designs and patents. It provides enhanced protection for Geographical Indications (GIs), opening the door for expanded recognition of European food and beverage names in India and Indian specialties in EU markets. The text also includes commitments on border enforcement to combat counterfeit goods and improve cooperation between customs authorities.
The chapter on sustainable development obliges both parties to effectively fulfill their obligations under international labor and environmental treaties.
