Adam Silver confirms ‘burden of proof’ to NBA in Kawhi Leonard -Tononde

Rick Buchanan, our general counselor who supervises all investigations,” Silver explained. “Rick had a conversation with Steve Ballmer, and we soon concluded that this was something that came to the level that required an investigation, and in fact one that was done outside our office.”

When asked about possible penalties, Silver confirmed that his authority extends over several areas. The Commissioner can impose financial fines, remove draft choices and suspensions, among other things, provide disciplinary measures.

“My powers are very wide,” said Silver. “Full range of financial fines – design choices, suspensions, etc. I have very broad powers in these situations.”

Silver acknowledged that the NBA works differently than a court while retaining the standard of the burden of proof. The League retains a broad authority to revise all information and to weigh evidence accordingly in the disciplinary procedures.

“The answer is that at the end of the day we are not a court that we have a broad authority to look at all information and weigh it accordingly,” Silver concluded.
