NBA Commissioner Adam Silver emphasized that the competition bears the burden of proof in its investigation into the potential salary limit of the Los Angeles Clippers with the $ 28 million aspiration approval agreement of Kawhi Leonard. “Number one, the burden is on the competition if we discipline a team, an owner, a player or a constituent members of the competition,” Silver said. “I think that, as with any process that requires a fundamental sense of honesty, the burden on the party must be that essentially yields charges.”
The Commissioner emphasized his dedication to honestly treat all parties during the research process. Silver referred to public perception and the potential for false conclusions in high -profile situations.
“I wish someone else is in the situation Mr Ballmer now, or Kawhi Leonard, by the way, to be treated in the same way as I would like to be treated if people would make accusations against me,” Silver said.
Indirect evidence standards detailed
Silver clarified the approach to the competition to evaluate evidence outside of direct evidence. The Commissioner used an analogy of smoking gun to explain how indirect evidence of factors in research factors.

Silver revealed that he was not aware of the allegations until a recent Pablo Torre discovered that Podcast appeared the information. The Commissioner said he had never heard of aspiration or any approval scheme between Leonard and the company.
“Well, when the podcast came out, it was news for me,” Silver said. “To be honest, I had never heard of the business spiration before, and I had never heard of anything about an approval agreement with Kawhi or something around engagement with the Los Angeles Clippers.”
The NBA quickly determined that the case required investigation by an external party. Wachtell Lipton, a law firm in New York that was previously used by the competition for similar investigations, supervises the probe.
“We spoke internally. Rick Buchanan, our general counselor who supervises all investigations,” Silver explained. “Rick had a conversation with Steve Ballmer, and we soon concluded that this was something that came to the level that required an investigation, and in fact one that was done outside our office.”
When asked about possible penalties, Silver confirmed that his authority extends over several areas. The Commissioner can impose financial fines, remove draft choices and suspensions, among other things, provide disciplinary measures.
“My powers are very wide,” said Silver. “Full range of financial fines – design choices, suspensions, etc. I have very broad powers in these situations.”
Silver acknowledged that the NBA works differently than a court while retaining the standard of the burden of proof. The League retains a broad authority to revise all information and to weigh evidence accordingly in the disciplinary procedures.
“The answer is that at the end of the day we are not a court that we have a broad authority to look at all information and weigh it accordingly,” Silver concluded.
The Commissioner emphasized his belief in the decent process during the investigation. Silver emphasized the importance of allowing external research to conduct his course before he came to conclusions.
“Again, I would also say that I have been in the competition long enough in different permutations of allegations and accusations that I am a strong supporter in the right process and fairness, and we must now let the research run his course,” Silver said.
