Little Rock, Ark. – The widow of a director of the Airport of Arkansas who was killed during a desk for alcohol, tobacco, firearms and explosives that had fallen into his house last year, the desk and various officials complained and claimed that the agency and officers acted recklessly and negligently.
Bill and Hillary Clinton National Airport Executive Director Bryan Malinowski died days after he was shot when ATF agents performed an order on March 19, 2024, in his house in Little Rock.
The ATF said that Malinowski shot at agents, a striking and injury of one, after which agents returned.
A statement that was released after the shooting said that the order was related to accusations that Malinowski bought more than 150 guns between May 2021 and February 2024 and that he resold a lot without a dealer.
In the court case, submitted to the federal court in Little Rock, Maria “Maer” Malinowski accused the ATF and 10 agents and Taskforce officers of violating the constitutional rights of her and her husband.
The lawsuit is not looking for damage and asked for a jury court.
“The Constitution requires reasonableness and, in particular here, that the defendants go and announce both their presence and their goal and wait a reasonable time before entering,” said the court case. “The ATF did not do this, which resulted in a completely predictable, unnecessary and tragic result.”
The ATF said it does not comment on current legislation.
A Local public prosecutor Last year said that an ATF agent was justified in the fatal shooting of Bryan Malinowski. The death of Malinowski led to criticism from some Republican legislators in Arkansas who have called for more information from the ATF.
Malinowski was a lifelong weapon collector who would attend shows at the weekend where he would buy, sell and exchange with others, the lawsuit said.
He did not know that he was being investigated and reasonably believed that the agents who entered his house were intruders because they were not right and gave him enough time to get to the door, the complaint said.
“Today’s lawsuit is looking for justice for the nightmare I have lived in the last 14 months,” said Maria Malinowski in a press release.
