HC rejects the plea to release the person who have been arrested under preventive detention law-1986

The Supreme Court of Telangana has rejected a written petition that was submitted by a woman Dharavath Laxmi of the Warangal district looking for a direction to free her husband Dharavath Dhanising who was arrested under the provisions of the Telangana Verbodswet 1995 and Telangana Preventive detention.

A bench by Justices Moushumi Bhattacharya and BR Madhusudhan Rao said in his opinion that it “found no reason to interfere with the disputed order of the preventive detention that was submitted on November 25, after which the person’s husband was placed in the prison.”

Mr Dhanisingh was accused of making and selling illegally distilled drinks (IDL). He was arrested more than three times as he owned IDL. Ultimately, De Warangal District Collector approved an order for his detention that led to his arrest. This challenged this and approached the HC.

Although the plea rejects, the bank said that the arrested person cannot be kept in prison for an indefinite period of time on the pretext of continuous investigation. “The authorities involved must ensure that the legal system is activated and maintained to conclude the investigation as quickly as possible and preferably by December 31, 2025,” the bank said.
