The Allahabad High Court has granted bail to an accused rape While observing that failed relationships increasingly led to the abuse of criminal law. The order was passed on 9 April by Justicehan Pahal while hearing the bail request from a 42-year-old man accused of rape by a woman, according to a bar and bench report.
“It is increasingly noticed that personal fallouts and emotional disagreement are getting a criminal color, due to the call of penal laws, in particular in the aftermath of failed intimate relationships,” the court said.

The lawyer who represents the suspect, however, told the court that the woman had a relationship with the man, even though he knew he was married. However, he denied that he had previously married three women.
After the arguments, the Supreme Court said that the case seemed to be the product of an emotional aftermath after a break instead of a case of criminal misconduct.
“Not all social or ethically questionable actions justify legal intervention. It also reflects a fundamental principle in case law – the law does not enforce all aspects of morality,” the judge said.
The court also noted that the relationship was consensual and the woman knew the previous marriage history of the suspect.
