Thante Gaushala fined for accusing the court of ‘bias’ above the plea for custody of animals

A Thante Sessions Court imposed a fine of RS 10,000 on Monday on Shree Leela Purshottam Gaushala Seva Trust for the search for the transfer of the transfer to a case, claiming that it would not get justice from the court concerned. The Gaushala had moved an application for transferring procedures with regard to the interim custody of animals seized under the Maharashtra Animal Preservation Act, 1976.

The animals were detained by the police of Bhoiwada and transferred to the Gaushala. The accused in the case later sought temporary custody of the animals, to which the Gauslaa responded with his own guardianship application.

According to the Gaushala, the court showed a bias during the hearing. It claimed that the judge seemed to have decided after the suspect’s lawyer had put forward the case in detail, while the Gaushala lawyer only received five minutes.

Below the Gaushala approached the Sessions Court for the transfer of the case and for the removal of certain structures in the order of the lower court.

However, Sessions judge SB Agarwal noted that the lower court had actually recorded the behavior and order of events. According to the order, the Gaushala lawyer asked 1.5 to 2 hours to argue the case, to which the judge replied that he was in charge of four courts and had to give a judgment.

After this, the lawyer began to shout in court and said that he had lost confidence in the proceedings and would not further argue the case.

Judge Agarwal ruled that although a reasonable fear of bias is needed to justify the transfer of a case, there was no one in this case. He also rejected the plea to remove parts of the earlier order and stated that they had not been brought to structures.

“In such circumstances, the application earns it to be rejected with a fine,” judge Agrarwal remarked while he ordered the Gaushala to deposit RS 10,000 within two weeks.
