Judge Arun Subramanian denied Combs’ motion and instead made other recommendations.
Sean “Diddy” Combs’ request to serve his 50-month sentence at FCI Fort Dix in New Jersey has been denied.
Judge Arun Subramanian denied the motion and instead instructed that Combs serve his time “as close to the New York metropolitan area as possible.”
Diddy’s attorneys requested his placement at Fort Dix to gain access to the Bureau of Prisons Residential Drug Abuse Program (RDAP). Inmates in the RDAP program housed at Fort Dix are provided with separate housing from the general population. They may also register for half-day work, school or professional activities. As a result of the facility’s flexibility, Combs’ legal team claims the New Jersey facility will give him better access to his family.
“To address substance abuse problems and to maximize family visitation and rehabilitation efforts, we strongly request that the Court recommend to the Bureau of Prisons that Mr. Combs be placed in FCI Fort Dix for RDAP purposes and any other available educational and vocational programs,” the filing said.
In his rejection, Subramanian cited concerns about security, logistical limitations and administrative authority. Subramanic clarified that his judicial authority allows him to recommend a geographic zone, but the actual placement is under the jurisdiction of the Bureau of Prisons. Combs’ team has until Oct. 10 to apply for another facility closer to the metro area.
Combs’ attorneys have signaled plans to appeal both the conviction and the placement decision. Meanwhile, corrections officials will now determine his final assignment, which may be outside the New York area but still within the judge’s recommended zone.
Combs was convicted under the Mann Act in July on two counts of transporting persons for the purpose of prostitution. He was acquitted of more serious racketeering charges. He was sentenced on October 3 to 50 months in prison, a $500,000 fine and five years of supervised release. Credit for time already served could shorten his remaining term to approximately three years.
